  1. About Ipsify

The company Ipsify AB (559477-6535) is based in Trollhättan, Sweden.

  1. Orders

Once you have completed your order, an order confirmation will be sent to your email address. The confirmation includes all details regarding products, prices, billing address, and delivery address.

If there is anything incorrect in the order confirmation, please contact us immediately via email at info@ergilo.com.

  1. Delivery

Our normal delivery times are 6–12 business days. Please note! Orders placed during weekends will be shipped no earlier than the following Monday.

Due to high workload at postal carriers, delays may occasionally occur. We kindly ask for your understanding, as this is unfortunately beyond our control.

If a delivery delay occurs (without us notifying you of an extended delivery time), please contact us at: info@ergilo.com.

Please note that additional customs duties & VAT charges may apply, as you as the customer act as the private importer of the product you order.

  1. Pricing

All prices in the store are displayed in the current currency and all prices are excluding VAT.

We reserve the right to adjust prices due to supplier price changes, printing errors in price lists, or inaccuracies caused by incorrect information, and we reserve the right to correct any such pricing errors.

  1. Right of Withdrawal

When purchasing goods on the website, you as a customer have a 30-day customer satisfaction guarantee starting from the day you receive the item you ordered.

5.1 When exercising your right of withdrawal:

You must notify us that you wish to cancel your purchase. The message should be sent to us at info@ergilo.com. Your message must clearly include your name, address, email address, order number, and which items the return applies to.

You should return the products to us immediately and no later than within the legally required 14 days after notifying us of your withdrawal.

We cover return shipping costs for size exchanges, but if you wish to return the product for a refund, a return shipping fee of SEK 100 will apply and be deducted from the refund amount. To ensure the products arrive in good condition, please return them properly packaged. This helps us process your return as smoothly as possible

5.2 The right of withdrawal does not apply to:

Custom-made products tailored specifically for you or products with a clear personal customization according to your wishes.

  1. Claims and Complaints

We inspect all products before they are shipped to you. Should the product still arrive damaged or incorrectly delivered, we undertake, in accordance with applicable consumer protection legislation, to rectify the issue free of charge.

You must always contact us for approval before returning a defective item.

Complaints must be submitted immediately after the defect has been discovered.

6.1 How to proceed with a complaint

Any faults or defects must always be reported to info@ergilo.com including your name, address, email address, order number, and a description of the defect.

If we are unable to correct the defect or deliver a similar product, we will refund you for the defective product in accordance with applicable consumer protection legislation. We cover return shipping costs for approved complaints.

We reserve the right to reject a complaint if it turns out that the product is not faulty according to applicable consumer protection legislation. For complaints, we follow the guidelines of the Swedish National Board for Consumer Disputes, see arn.se.

  1. Limitation of Liability

We accept no responsibility for indirect damages that may arise due to the product.

We accept no responsibility for delays/errors resulting from circumstances beyond the company’s control (Force Majeure). Such circumstances may include labor disputes, fire, war, government decisions, reduced or failed delivery from suppliers.

Furthermore, we accept no responsibility for changes to products/product features made by respective suppliers or other factors beyond our control.

  1. Product Information

We reserve the right for any typographical errors on this website and for products being sold out. We do not guarantee that the images accurately represent the exact appearance of the products, as some color variation may occur depending on monitor settings, photo quality, and resolution. We always strive to display the products as accurately as possible.

  1. Information About Cookies

According to the Electronic Communications Act, visitors to a website must be informed for privacy purposes that cookies are used. Information in cookies may be used to track a user’s browsing. A cookie is a small text file that the website you visit requests to save on your computer in order to provide access to various functions. You can set your browser to automatically reject cookies. By shopping at Ipsify AB, you accept our privacy policy and our processing of your personal data. We protect your personal privacy and do not collect more information than necessary to process your order. We never sell or share your information with third parties without legal basis.

Ipsify AB is responsible for the processing of personal data that you provide to us as a customer. Your personal data is processed by us in order to manage your order and, in cases where you have requested newsletters or promotional offers, to tailor marketing to your individual needs.

Below is a summary of how we, in accordance with the General Data Protection Regulation (GDPR), store and process your data.

10.1 What is personal data?
Personal data is any information that can directly or indirectly be linked to a natural person.

10.2 What data do we store?
To manage your order and answer questions related to your order (customer service), we store your first and last name, address, phone number, email address, IP address, and purchase history.

Your data is stored as long as we have a legal basis to process your data, for example to fulfill the agreement between us or to comply with legal obligations such as accounting legislation.

10.3 Legal basis
In connection with a purchase, your personal data is processed to fulfill the agreement with you.
Marketing, campaigns, and similar mailings are carried out based on your consent.

10.4 What information is shared and for what purpose?
10.4.1 Payment providers

When making a purchase, information is shared with our payment providers. Stored information includes first name, last name, address, email address, and phone number. If you choose invoice payment, your personal identity number is also stored by the payment provider. The information is stored in order to complete the purchase and protect the parties against fraud.
The payment providers (payment services) we use are: Card Payment, Klarna, and MobilePay.

10.4.2 Shipping companies
To deliver your orders and fulfill our agreement, we must share specific information with shipping companies. Information shared includes first name, last name, and delivery address details. Email address and/or mobile number may also be shared with the shipping company for delivery notifications.
The shipping companies we work with are: PostNord.

10.4.3 Newsletters
If you choose to subscribe to our newsletter, your first name, last name, and email address are shared with our newsletter provider. This is to keep you updated with information and offers for marketing purposes.
We use Klaviyo for sending newsletters.

10.5 Right of access
You have the right to receive an extract of all information we hold about you. The extract is delivered electronically in a readable format.

10.6 Right to rectification
You have the right to request that we update incorrect information or complete incomplete information.

10.7 Right to be forgotten
You may request at any time that the data concerning you be deleted. There are a few exceptions to the right of deletion, such as when data must be retained to comply with a legal obligation (for example under accounting legislation).

10.8 Responsible for data protection
Ipsify AB is responsible for the storage and processing of personal data in the online store and ensures compliance with applicable regulations.

10.9 How we protect your personal data
We use industry standards such as SSL/TLS and one-way hash algorithms to securely store, process, and communicate sensitive information such as personal data and passwords.

  1. Changes to the Terms and Conditions

We reserve the right to make changes to the terms and conditions at any time. Changes will be published online on the website. The updated terms are considered accepted in connection with orders or visits to the website.

  1. Disputes and Governing Law

If a dispute cannot be resolved in agreement with the company’s customer service and the customer, you as a customer may contact the Swedish National Board for Consumer Disputes, see arn.se. Residents of EU countries other than Sweden may submit complaints online through the EU Commission’s dispute resolution platform at http://ec.europa.eu/consumers/odr

In the event of a dispute, we follow decisions from ARN or equivalent dispute resolution bodies.

Disputes regarding the interpretation or application of these terms and conditions shall be interpreted in accordance with Swedish law.
